Small Business Restructuring also known as SBR
The SBR process is designed to help small businesses restructure their debts while maintaining control of their operations.
The business appoints a Restructuring Practitioner who helps devise a restructuring plan.
This process provides the following key benefits:
- allows small businesses to restructure without losing control.
- provides a quicker and less costly process compared to traditional insolvency.
This framework aims to provide small businesses with a viable path to recovery while balancing the interests of creditors.
-
Voluntary Administration
Voluntary Administration is a formal insolvency process for companies facing financial distress such as being the subject of a winding up application.
This process provides an immediate moratorium on creditor actions against the Company and personal guarantees against director/s.
It allows the Voluntary Administrator to make a financial assessment of the Company and provide the director/s or third parties the opportunity to formulate a proposal to put before creditors for their consideration.
It is an effective tool for Company's to restructure financially and move forward with certainty.
-
Liquidation
In instances were Company's can no longer meet its financial obligations, the appointment of a Liquidator allows for the orderly winding down of the Company's affairs. This includes:
- the wind down of business operations.
- the sale of assets.
- dealing with employee entitlements.
- dealing with creditor enquiries.
- attending to regulatory requirements.
Our service looks to free director/s from the ongoing financial stress and their potential exposure to being personally liable if they continue to trade insolvent and/or are issued Director Penalty Notices from the Australian Taxation Office.
